    In a real estate law matter, Blackwell c. Ville de Barkmere, concerning the requirement to obtain a municipal permit to build a vehicular access due to the property’s enclosed position, the Court of Appeal of Quebec overturned the trial decision. Drawing on a comparative international law analysis, the Court reaffirmed the conditions under which a legitimate expectation may arise for a citizen, based on the conduct of a public body. Ultimately, Quebec’s highest court concluded that the process for issuing a construction permit constitutes a non-discretionary power.
